FERC Revisits Assessment of Policy Statement on Interstate Natural Gas Pipeline Proposals

On February 18, 2021, the FERC revisited its evaluation of the 1999 Policy Statement on the Certification of New Interstate Natural Gas Facilities and is soliciting new data and additional stakeholder points of view that would help the agency update the process by which it reviews proposed natural gas projects. Recognizing that many changes have occurred since its initial inquiry three years ago, the FERC is focusing on adding to the record already established in response to its April 2018 Notice of Inquiry (NOI), and it is soliciting comments on new questions that add to or modify the initial NOI. {expires: 2021-05-10}

This NOI seeks comment on matters including the following:

  • how the FERC determines the need for a project
  • the exercise of eminent domain and landowner interests
  • the FERC’s consideration of environmental impacts
  • improvements to the efficiency of the FERC’s review process
  • how the FERC identifies and addresses potential health or environmental effects of its pipeline certification programs, policies, and activities on environmental justice communities

Interested parties are invited to submit questions or remarks related to the matters and issues proposed in this NOI. The public comment period will remain open for 60 days following publication in the Federal Register. Comments may be submitted electronically by visiting http://www.ferc.gov. Documents created electronically using word processing software should be filed in native applications or print-to-PDF format and not in a scanned format. Paper submissions may be mailed to: Federal Energy Regulatory Commission, Office of the Secretary, 888 First Street NE, Washington, DC 20426. Submissions should refer to Docket No. PL18-1-000 and must include the commenter’s name, address, and organization, if applicable.
